Terms of service

The service

SmsDesk lets a business and its staff send and receive text messages with the business's customers from the business's phone number, through a web portal. By using SmsDesk, the business ("you") agrees to these terms.

Your responsibilities

Text messaging program

Texts are sent on behalf of the business named in the conversation. Message frequency varies with the conversation. Message and data rates may apply. Recipients can reply STOP to opt out or HELP for help at any time. Carriers are not liable for delayed or undelivered messages. The full text messaging terms explain how recipients agree to texts and how to stop them.

Carrier registration

US carriers must approve each business before it can text. Approval is up to the carriers, and they may suspend texting for a number that breaks their rules. We'll help with registration but can't guarantee approval.

Fees

You pay the fees we agree when we set up your account. We'll give you at least 30 days' notice of any price change. Carrier registration fees are passed on at cost.

Availability

We work to keep SmsDesk running at all times but can't promise it will never be interrupted. Text messages travel over carrier networks we don't control, so delivery can't be guaranteed.

Ending the service

You can stop using SmsDesk at any time. We may suspend or end an account that breaks these terms or carrier rules. After an account ends, its data is deleted as described in our privacy policy.

Liability

To the extent the law allows, SmsDesk isn't liable for indirect or consequential losses, and our total liability is limited to the fees you paid in the three months before the claim.
